As we improve our services, here are the Data Privacy Guidelines for Shipments and Delivery for our buyers and sellers:
What do we collect, and why?
We request photos on delivery from our Third-Party Logistics (3PL) partners. The collection of photos is done using 3PL’s secured rider application interface and/or 3PL rider’s company-issued mobile phone, as the case may be. The Delivery Photos are intended to help customers know that their package was safely delivered and where, picked up, or canceled to ensure the protection of our Buyers, Sellers & Partners and for internal audit purposes.
We recommend that the Buyer/Recipient agree to the request for Proof of delivery from our Third-Party Logistics (3PL) partners as this will assist in properly resolving applications for return/refund, if any.
Manner of Collection
Consent is an essential element for taking the delivery photo. Before taking a delivery photo of the Customer/Recipient/Data Subject with the parcel, a CONSENT from the Customer/Recipient/Data Subject should ALWAYS be secured by the 3PL Rider.
In the event the Customer/Recipient/Data Subject refuses the above, the 3PL rider will request the consent of the Customer/Recipient/Data Subject to capture proof of the following:
House number and parcel
Parcel with geotagging
In every instance, the delivery photo will focus on the placement of the package and clearly show the airway bill.
If any of the above options are declined by the Customer/Recipient/Data Subject, the 3PL rider will note that the Recipient did not consent to the delivery photo and shall use GeoTagging as proof of delivery. GeoTagging is the process of adding geographical information within a platform. This is commonly used in media files to help indicate the exact location. This will be used to indicate the designated location of the Seller or Buyer.
If no one receives the package, the delivery will be returned to the sender and the 3PL rider will use GeoTagging as proof of an attempt of delivery.
If the captured photo will be used for other purposes, customers should be notified of the new purpose and re-collect their consent.
Packages shall not be delivered to or left with minors except upon the written instructions of the buyer who is the minor’s parent or guardian. Photos of minors shall not be taken under any circumstances.
In the event that a minor receives delivery on behalf of the buyer in accordance with the buyer’s written instructions, the Buyer shall hold Shopee, the 3PL Provider, and the 3PL Rider free from any and all liability that may arise therefrom.
Data Retention
The Delivery Photos and GeoTagging information shall be retained strictly based on the retention policy of the 3PLs. If the 3PL has no retention policy, the captured photos should be strictly retained only until 90-days from the time it was collected as long as there are no legal or compliance requirements mandating retention for a longer period.
The Delivery Photos captured are also made available in the buyer’s Shopee app order and delivery details for ninety (90) days retention when it was uploaded by 3PL Partner.
